This Pilot Website Development & Testimonial Agreement (“Agreement”) is entered into by and between Viral Mamba, a digital marketing agency legally registered at 3571 Far West Blvd, Ste 3797, Austin, TX 78731, and operating out of the Metro Detroit area (“Viral Mamba”), and the undersigned client (“Client”).
Viral Mamba is offering a limited pilot program to selected contractors and home service providers for the design, build, and live deployment of a modern, conversion-focused website (“Website”).
As part of this pilot, no upfront build fee is required, provided Client complies with the obligations below.
Viral Mamba will design and deploy a custom website determined at its professional discretion, which may include mobile-first design, conversion-focused layout, and contact functionality.
Client authorizes Viral Mamba to deploy the Website live upon completion unless material objections are raised prior to launch.
Client agrees to provide timely access to required information, branding assets, and approvals. Delays caused by Client may delay delivery.
Within seventy-two (72) hours of the Website going live (“Launch Date”), Client must complete one of the following:
If satisfied:
Client agrees to provide a video testimonial, minimum 30 seconds, with face visible, that includes:
Client’s first name and business name
A statement about Client’s experience working with Kris Minter and Viral Mamba
General feedback on the Website and build process
Client agrees not to mention pricing, fees, or specific costs. General statements such as “affordable” or “fit our budget” are permitted.
Client also agrees to provide a public written review (e.g., Google Business Profile), if genuinely satisfied. Written reviews may not reference pricing.
If not satisfied:
Client must submit a clear written list of requested revisions within the 72-hour period. No testimonial or review is required at that time. Testimonial obligations apply only after satisfaction is confirmed.
Emails, texts, or messages do not substitute for the required video testimonial.
Failure to provide the required testimonial or revision request within 72 hours constitutes a material breach.
In such case, Viral Mamba may suspend, disable, or remove the Website without liability for downtime, lost revenue, or damages.
Ongoing website management, updates, automation, or hosting services are optional and governed by a separate agreement. Client is under no obligation to continue services beyond the pilot.
The Website, including all underlying code, structure, and design elements, remains the sole property of Viral Mamba. Client does not acquire ownership rights to the Website under this Agreement.
As part of the pilot program, Client is not required to pay any ongoing monthly fee to keep the Website hosted, accessible, and live, provided Client remains in good standing with the obligations outlined in this Agreement.
Pilot program participants are eligible for a discounted Managed Maintenance Plan at $97 per month (regularly $297/month). This optional plan includes unlimited revision requests for reasonable changes, such as updates to text, images, page sections, layout adjustments, and embedded media (including video embeds). Revisions are limited to modifications that do not materially alter the core structure or scope of the Website.
Advanced services, including but not limited to automation systems, CRM access, AI reception, lead management workflows, custom development, or significant structural changes, are not included in the $97/month plan and may require enrollment in a higher-tier plan or separate agreement.
Eligibility to purchase ownership of the Website may be considered only after Client has maintained an active $297/month plan for a minimum of twelve (12) consecutive months. Any purchase option is discretionary, not automatic, and subject to separate written terms.
Viral Mamba makes no guarantees regarding revenue, lead volume, or business outcomes.
Client agrees to indemnify and hold harmless Viral Mamba from claims arising from Client’s business or content.
To the maximum extent permitted by law, Viral Mamba’s total liability arising out of or related to this Agreement shall not exceed the total amount actually paid by Client to Viral Mamba under this Agreement.
Neither Party shall be liable for delays caused by events beyond reasonable control.
This Agreement shall be governed by the laws of the State of Texas.
This Agreement constitutes the entire agreement between the Parties and may be executed electronically.
By signing below, the Client confirms they have reviewed, understand, and agree to all terms of this Agreement with Viral Mamba, including the testimonial and ownership provisions.
